New legislation pertaining to electrical safety in private rental property came into force in July 2020. This legislation demanded that landlords must provide new tenants with the EICR (electrical installation condition report). From April 2021, you will be required to provide electrical safety certificates for existing tenancies. It also demands that future electrical inspections are carried out at five year intervals, as is also required with HMOs. The legislation is applicable to the installation but not the appliances. That comes under the requirements for PAT testing.

Landlord Electrical Safety Certificate Exceptions

The majority of tenancies in the private rental sector are covered by the regulations, however, there are some excluded tenancies. As a Bromley Landlord, you are not required by the new legislation to provide an EICR in the following cases:

– Rentals where the landlord lives in the building
– Tenancies with a right of occupation for seven or more years
– Halls of residence, refugee care homes, hospices and hostels
– Registered social housing
– If you are taking in lodgers

Despite the exemptions, it is nevertheless good practice to have the wiring professionally checked regularly. A check every five years would be appropriate, in line with July’s legislation.

What the EICR Involves

Our engineer arrives at your property and will inspect all aspects of the electrical installation – consumer unit, wiring and outlets, earthing and bonding. Provided all is well with the system, a certificate is then issued. The certificate will also indicate if further investigation is required or areas where remedial work is needed. Once this is all completed, the certificate will be issued. A copy of the certificate must be given to new tenants within 28 days and tenants also have a right to ask for the certificate. In the latter case, you have 28 days to comply.

Local Authority Powers

Local authorities now can enforce compliance. If they suspect that a Bromley landlord is in breach of the new regulations, they can demand a copy of the EICR. You must supply this within 7 days. Should the local authority serve a remedial notice, you have either 21 days to submit a written representation if you feel the notice is unwarranted or 28 days to carry out the work. Non-compliance can lead to a penalty of anything up to £30,000.
