EICR Legal Requirements and Responsibilities

Prior to July 1st 2020, there was no legal requirement for landlords to obtain an electrical installation condition report (EICR). The government changed that in order to ‘make sure the private rented sector will offer high quality, safe and secure housing’. They also acknowledge that many ‘good landlords’ already routinely carry out an EICR and perform necessary remedial work without it being the law.

Timing

For tenancies arranged since June 1st 2020, the EICR is immediately required, however, for existing tenancies at that date, you have until the end of March 2021 to comply.

Key Points of the EICR regulations

Landlords supplying privately rented accommodation have to:

• make sure electrical safety standards are met
• get the electrical installations in their rented properties checked at least every five years
• use a qualified and competent electrician to carry out the inspection
  set a date for the next inspection
• complete any remedial work within 28 days of the inspection and supply written confirmation to tenant and local authority within 28 days of completion of the work

Landlords EICR Certificate Responsibilities

Once our electrical installation inspector has checked your system, you will be given your EICR with the date for your next inspection and test. This needs to be supplied to an existing tenant within 28 days of the inspection and test.

If your property is between tenancies, the report must be supplied to the incoming tenant prior to the start of their occupancy.

If you are in the situation of trying to find a new tenant, the report must be supplied within 28 days of any request, though we doubt that you would ever leave it that long!!

The local authority may request a copy of your EICR, in such a case, you only have 7 days to submit it. You also need to retain a copy in order to give it to the electrician who carries out the next test.
